Default If my husband and I get divorced, will my step-son still be allowed to stay on

my health insurance? I don't want him to go without insurance. He's 10.

Not unless you've adopted him. There are no legal rights for step-parents/children when divorced.

Since he's not your "biological child" he will be removed, but I'm sure you can keep him on by writing a letter explaing this to your employer/Human Resource.

That would all depend on if he's living with you at least 50% of the year. If he is you should be able to and if not then it would be his father's responsibility. When I was married I had tried to have my step-daughter put on mine to help her mom out and I couldn't do it because she was only over 35% of the time. My insurance company wouldn't allow it and my guess is yours probably won't once you divorce.

This is not a matter of law but of the individual insurance carrier. And most, if not all, require an 'insurable interest' in the underlying subject.

Therefore, if you have court ordered custody or visitation or other such 'guardianship' then you have an insurable interest. Otherwise, the company is well within their rights to deny coverage.

Yes he will, went through exact same thing!
All u do is take hubby off leave kid on, most ins. companies don't ask for verification. No questions asked!

I doubt it. He's not your flesh and blood (outside of the marriage). And you have not adopted him.

You might want to call up your insurance company today and see if the will allow it...
