Default Life insurance questions??

A co-worker of mine mentioned his uncle has been declared missing(has been missing for almost 2 weeks now). I guess he was hiking somewhere near the Rocky's and never came back that day. Since no one is able to find him, and many believe he is dead, how is his wife and kids going to support themselves? Will his life insurance only come through once his body is found and confirmed dead?

They need to get a lawyer, file the proper paperwork to have him declared legally dead and be prepared to sue the insurance company to collect...
