Need Legal Help Or Resources Regards My Mums Life Insurance?
My mum passed away on 7th May 2004. Approx 3-4 days later I contacted the broker in whom both my parents had their Insurance policies with & told them the unfortunate news, I also wanted to know if we could get an advancement of Mum?s Life Insurance, they advised of course it is ususally 10 percent. I told them it would be greatly appreciated as no one in the family had enough money to cover the funeral costs. They asked me to provide them with my mothers birth certificate & death certificate. I at the time couldn?t provide them with a copy of the death certificate as the coroner was still investigating my mothers death as she died suddenly but I gave them the coroners letter confirming my mothers death along with my mothers birth certificate.
There was a bit of controversy over my mothers original birth certificate name & her name she used once she came to Australia as she was born in England. I advised them that in England the middle name appears first & the first name second on her birth certificate as that is the way they do it their. The broker accepted this but said they still needed the death certificate. We finally got the death certificate but their was no cause of death as it was still being determined. I submitted this & once again they rejected this & said they needed the death certificate with the cause of death listed.
My mothers funeral service was held on 14th May 2004 thanks to my grandmother she greatly paid all costs so we could let her rest in peace without to much burden on the family & still no help from A,C & L. We finally got the death certificate with the cause of death listed & to our shock & horror the cause of death listed was hyperthermia due to alcohol intoxication it was awful that they listed my mothers death this way she at times she was a bit of a binge drinker but not a dependent alcoholic. We gave this to the broker & this is when the communication broke down.
A,C & L started ordering all of my mothers records & also A,C & L personally wanted to investigate myself & my sister & ask us all sorts of questions about my mother. We denied the interview as it was to sudden after mum passed away.
We had a solicitor to help communicate with A,C & L but they just said they are still investigating & waiting on all medical records.
My Father who also had Life & Income protection with A,C & L was the policy owner over my mothers policy of Life Insurance as advised by A,C & L & when my father was unable to work due to his illnesses he started claiming on his income protection insurance, which they paid repectivefully for some time until 6 months after my mother passed away they avoided the whole policy from inception as they claim that my father non-disclosed certain medical information of pre-existing illnesses & had they known at the time of Insurance was taken out they never would have accepted his request to be insured.
Due to this reason A,C & L advised that my mother Insurance policy for Life Insurance isn?t worth the paper it?s written on.
Still to this day there has been no resolution & FIC?s can?t deal with my mothers case due to the amount insured & A,C & L were happy as they knew FIC?s couldn?t deal with it.
