Default what can i do if not happy with insurance payout on my car when it wasnt

even my fault? some one went into the back of my car in a works van it has gone through insurance and a inspector has been out to see my car and they have decided to write it off, the car has just gone through a mot in december and the engine has been re built as the cam belt went on it it is a old car ford fiesta n reg diesel but it is a gud runner and they are still fetching upto £1200 but insurance have offered me £340 theres no way i will get a car that runs as good as mine for that it wasnt my fault and i am losing out the damage was the left quarter panel dented it and took my light of what can i do i have turned down that offer and been told to send my mot any service history, and what work i have done on the car to them so they can look at it again but why should i miss out on not having a car

You do what I did - you TELL them that their offer is not good enough and that they must replace the car with one of the same model, engine size, colour and same mileage and condition as your original.

They then have to do all the work and recover the money from the other parties insurance.

You couls also hunt around on AutoTrader website - www.autotrader.co.uk and find a car similar and print the page off to send to them showing the sale price.

Also - go to local garages and see the prices of similar age/type of car - take a digital picture and use those as your point of reference - the replacement cost of the car is what it costs to replace - not what they offer.

It all depnds on what those factors dictate as to haow much they will give you - you may find that the above places only value the car at £200 - it is a chance you take but you never accept their first offer anyway.

I ended up with 90% back

The insurance give you a fair price for the value of a ford fiesta of your registration age, and mileage. You can contest it if you so wish, but are unlikely to win on the grounds you have mentioned.

Your car may simply be "beyond economic repair"and not necessarily a write-off. You'll be lucky to get them to increase their offer very much although I would have thought that £700 would have been closer to the mark. All you're really entitled to is the market value, not its personal worth to you.
You may be able to negotiate a settlement figure that allows you to retain ownership and get it fixed cheaper than an insurer's body shop could do it.

You will have to prove to your insures that your car was in the condition you describe.Should you be certain that the accident was not your fault then contact the other party and send them the bill for all of your expenses relating to the circumstances.But really a car of that age is not worth much and not worth the extra money paid out for Comprehensive cover.It is regretable you are without transport but thats the name of the game with Insurance,Maybe you should consider settling for say £500 and call it a day.The expenses in Litigation could be high and you may lose out in the end.

It is always best to refuse the first offer from your insurance company. Put together all the evidence you have with respect the work carried out and forward it to them with a cover letter.

Well you can appeal, and might get a revised offer, but not as much as your estimate. Unless you have a guaranteed loan car arrangement with your insurance co. looks like you might be without for a while.. Ask them though.. Only other course of action is a private summons against the other driver and company for compensation. t
