...insurance, what happens? i got hit by a truck on my way to school, it was clearly his fault, but does not want to admit it, police did not show up because no one was injured. My name is not on the insurance on my car, only my dad. its only liability insurance. today i got a letter saying that my insurance might now cover the incident because i was the one that was driving. what happens in this situation? i think my car is going to be considered totaled, are they going to pay me?

If the other driver is found by his insurance company to be at fault then you'll be OK. If not, if you weren't listed as a driver on your dad's insurance policy and because he only had liability insurance to cover your car, you're pretty much screwed. Also, if you were found to be at fault, and are considered an uninsured driver then his insurance company can go after you for money to cover damages to his car.

If you are not covered on his policy then they will not pay for your car.You are out of luck on this one.The police was not called so you have no proof of who was at fault.

If you are a full time student you should be covered under your dad's policy anyway. Nobody will admit fault in an accident, hopefully you got all his insurance information. But your dad's insurance should pay for the totaled car.
