Default what can i get if injured in car wreck and car was also totaled what is...

...the insurance companie's responsibilit
I was sitting still ad a yield sign not realizing that someone was going to plow into me. The other driver simply wasn't paying attention.

Do not misunderstand, the insurance company has no responsibility to you; their responsibility is to their policyholder only. On his behalf, the insurance company will compensate you for your property damage. As for any injury claim, your injury must be directly related to, and a direct result of, the accident. These are 2 seperate claims, one not having any bearing on the other, meaning, the fact your car was totaled doesn't increase the value of any injury claim you present. Any compensation received for either claim is paid up to the limits of the policy and not a penny more.

What are The other factors? Were you drinking or high? Whose fault was it? Your question is very complex yet you give only a small portion of info.

You should consult a lawyer. The insurance company will do all it can to give you as little as possible. You should at least talk to a lawyer before discussing anything with an adjuster. Do NOT trust the insurance company.

It will depend on if the wreck involved another vehicle, who was at fault, and what kind of insurance coverage the party at fault carries. The insurance company is only liable to pay to the coverage limits.

You can get a lawyer, tell him your injuries and circumstanced of how the accident happen. Always get a insurance claim number being a driver or the passenger.
