Default Had a car crash with someone who wasn't insured, will I lose my no claims...

...despite it not being my fault? The other party came out of a side road, right into my path, so it was 100% their fault. The police did attend the scene and verified that the crash was caused by the other party. Now it turns out that they didn't have insurance. I fear now I'll lose my excess and NCD, it seems so unfair when there was nothing I could have done to avoid this.
