You need to file a claim with your insurance company now and here's why: if you have collision coverage that extends to non-owned autos (your girlfriends car) then your insurance should pay for the repairs less your deductible. As for liability coverage....your insurance policy will either pick up as excess coverage OR pro rata depending on what the liability wording is on your policy and your girlfriends policy. Your insurance company has the right to investigate all claims brought against you, just like they have the right to deny claims for not being able to investigate. If they MAY have to pay out under your liability coverage, they will want to evaluate any injury claims brought forth ESPECIALLY if they are asked to pay a pro rata share and they are going to want to be in agreement with the value of the injury claim with your girlfriends insurance before they pitch in any money. You need to tell your insurance your girlfriend only has liability coverage and they have an exposure they need to look into.

Her insurance is primary and yours is excess. You don't have to divulge your insurance information, but you should let your girlfriend's insurance know about who insures you and you should make a claim with them so they can have one on file and monitor what is going on.

absolutely give your insurance information to the claimants. If their injuries arent fully covered under her bodily injury yours could come in secondary....... i mean... unless youd rather them go after you personally for their injuries? i didnt think so!
